CashPass Card Terms & Conditions

CashPass is issued by Cash Converters Finance Limited. By using the card you agree to these terms and conditions (“Terms”), and the card fees (“Fees”) set out at https://www.cashconverters.co.nz/cashpass/.

  • Expiry: Your card is valid for 12 months from the date it is first activated. Your card cannot be used after expiry. Unused value on the card after the expiry date may be transferred to a new card purchased by you.
  • Activation: Your card must be activated before it can be used. To activate your card follow the activation instructions on the Website. When you activate your card you must select a card PIN. It is important you keep this PIN secret and do not share it with anybody else.
  • Fees: Fees apply for ATM transactions, ATM balance enquiries, EFTPOS transactions, and replacement cards. These are deducted from the value on the card immediately as the transaction occurs. See the Website for details.
  • Updates to terms/fees: We can update the Terms and Fees by posting the changes to the Website. If you have provided us with an email address, we will also email you about the changes. Changes will not take effect until at least 14 days after posting to the Website. Changes to the Terms and Fees will never be applied retrospectively.
  • Limits on card use: The card supports New Zealand domestic ATM and EFTPOS transactions. You must be physically present to use the card. The card does not work in manual card imprinters, where a merchant requires identity verification against the card details, or for international or online transactions. The card does not support direct debits, recurring payments, payment instalments, or foreign currency transactions.
  • No Interest: There is no interest payable to you on value loaded onto the card.
  • How the card can be used: You agree to only use the card in accordance with these Terms.
  • Exceeding the value on the card: Due to the way certain transactions are processed it is possible for a transaction to exceed the available balance on your card. You acknowledge and agree that where this occurs, any future funds loaded to the card will first be allocated to the overdrawn balance. You must not authorise or allow any transaction on the card where you know, or have reasonable grounds to expect, that it will exceed the unused value on the card.
  • Transaction limits: ATMs have different minimum and maximum transaction limits set by the ATM provider which we cannot control. We may also set minimum and maximum transaction and daily limits to help protect you against fraudulent transaction on your card. We will notify you if we place limits on your card.
  • Your responsibility for transactions on your card: You are responsible for the use and safety of your card. You must not give your card, card details or your PIN to anyone or let anyone else use your card. A transaction made using your card and authenticated with your PIN irrevocable instruction from you to us. You cannot stop a transaction made using your card once it has been authorised with your PIN.
  • Goods, services and refunds: We are not responsible for, and give no warranty for, any goods or services you obtain from a merchant using your card. Negotiation of any refund for goods and services purchased using your card is a matter between you and the merchant only.
  • Evidence of transactions: Unless fraud or gross negligence occurs, you agree that an amount shown on an EFTPOS receipt or ATM transaction receipt is conclusive evidence of the transaction having occurred.
  • Lost or stolen card: You must notify us immediately if your card has been lost or stolen by calling the customer service number. This also applies if the details on your card (such as card number and PIN) have or might have been disclosed to an unauthorised party.
  • Disputing transactions on your card: If you wish to dispute a transaction on your card you must tell us within 60 days from the day on which a disputed transaction occurred. You are not able to stop or reverse any transaction made with the card by you or with your permission. You cannot dispute a transaction if you change your mind about a purchase or make a mistake in the purchase. To lodge a dispute please call our customer service number.
  • Suspension: We can suspend your card without notice if we have grounds to suspect that the card has been stolen or compromised, is being used fraudulently or for other criminal activity, or in breach of these Terms. We will lift the suspension promptly once the matter has been resolved to our reasonable satisfaction.
  • Cancellation for fraud etc: We can cancel your card without notice if necessary to comply with a court order, or if we reasonably form the view that the card has been stolen or compromised, or is being used fraudulently or for other criminal activity, or in breach of these Terms.
  • Recording phone conversations and use of the Website: For security, training, and evidentiary reasons, we may record phone conversations or correspondence you have with us on any matter, either through the customer service number or directly with us, as well as your use of the Website.
  • Your rights as a consumer: You have rights under the Fair Trading Act, the Consumer Guarantees Act, and the Privacy Act. These rights are not affected by paragraph 21 below.   • Limits on our liability to you: Except for your rights under the Fair Trading Act, the Consumer Guarantees Act, and the Privacy Act, our liability to you in connection with your card will be limited to the unused value on your card, and we will not be liable to you in connection with your card for any consequential loss, or any loss of profits, loss of opportunity, or loss of reputation. For this purpose, loss is “consequential” if it relates to the particular purposes for which you are using or relying on the card, i.e. if other customers using or relying on the card for a different purpose would not necessarily suffer the same type of loss.
  • Indemnity: To the maximum extent permitted by law you indemnify us against all losses, claims, and expenses we may incur in connection with your use of your card.
  • Right to assign: We can assign any of our rights and obligations under these Terms to any other person or business, subject to that person or business assuming our obligations under these Terms. We can perfect the assignment by posting a notice to the Website. You cannot assign your rights or obligations under these Terms without our explicit written consent.
  • Severability: If at any time part of these Terms is found to be illegal, invalid, or otherwise unenforceable, then that part will be severed and will not affect the legality, validity, or enforceability of the rest of these Terms.
  • Conflict with laws: These Terms will affect your legal rights only to the extent permitted by law. Where the law says you have legal rights that cannot be modified or overridden by the terms of a contract, these Terms will be read subject to those legal rights.
